TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your use of chillhealth.club and any related webpages, booking links, online forms, communications, purchases, promotions, and services provided by Chill Health LLC, doing business as Chill Cold Plunge // Sauna Studio (“Chill,” “we,” “us,” or “our”).
By accessing our website, creating an account, making a purchase, booking an appointment, or using our services, you agree to these Terms. If you do not agree, please do not use the website or services.
1. Wellness Services and Medical Disclaimer
Chill provides general wellness and recovery services, including infrared sauna, cold plunge, contrast therapy, red light therapy, compression therapy, and related services.
Our services, website content, recommendations, and staff guidance are provided for general wellness and informational purposes only. They are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
You are responsible for determining whether our services are appropriate for you. Consult a qualified healthcare provider before participating if you are pregnant, have a medical condition, take medication, have concerns about heat, cold, light, circulation, or compression exposure, or are otherwise unsure whether a service is appropriate.
Stop your session immediately and notify a staff member if you experience pain, dizziness, difficulty breathing, numbness, unusual discomfort, or other concerning symptoms.
2. Liability Waiver
Before participating in Chill services, customers may be required to complete and sign a separate liability waiver and informed consent agreement.
These Terms do not replace the liability waiver. If these Terms conflict with the liability waiver regarding participation risks, assumption of risk, or release of liability, the liability waiver will control to the extent permitted by law.
3. Eligibility and Minors
You must be at least 18 years old to independently agree to these Terms or make purchases through the website.
Customers under 18 may participate only with the authorization of a parent or legal guardian and in accordance with Chill’s current policies. A parent or legal guardian may be required to complete applicable forms or remain present.
4. Accounts and Booking Information
You agree to provide accurate, complete, and current information when creating an account, booking an appointment, completing a waiver, or making a purchase.
You are responsible for protecting your account credentials and for activity conducted through your account. Contact us promptly if you believe your account has been accessed without authorization.
Bookings and purchases may be processed through third-party platforms, including Mindbody. Your use of those platforms may also be governed by their separate terms and privacy policies.
5. Appointments and Cancellations
Appointments are subject to availability and confirmation. Customers are responsible for reviewing booking details and arriving on time.
Cancellations, late arrivals, rescheduling, and missed appointments are governed by the policy disclosed during booking or purchase. Late cancellations and no-shows may result in the loss of a session or an applicable fee.
Chill may cancel or reschedule an appointment because of equipment issues, staffing limitations, weather, safety concerns, or other circumstances beyond our reasonable control. If Chill cancels an appointment, we will provide an appropriate rescheduling option, account credit, or refund based on the circumstances.
6. Purchases, Packages, and Memberships
Prices, packages, memberships, benefits, session quantities, expiration dates, and availability are subject to the terms displayed at the time of purchase.
Memberships that automatically renew will continue to renew at the applicable rate until canceled in accordance with the membership agreement and cancellation policy presented at enrollment.
Customers are responsible for reviewing all applicable terms before completing a purchase. Packages, memberships, and sessions may not be transferred, shared, extended, refunded, or exchanged except as expressly permitted by the applicable offer or Chill policy.
If these Terms conflict with a specific membership agreement, package description, or checkout disclosure, the more specific terms will control.
7. Prices and Payments
All prices are listed in U.S. dollars. Applicable taxes and fees may be added where required.
You authorize Chill and its payment-processing providers to charge the payment method you provide for purchases, recurring memberships, cancellation fees, or other authorized transactions.
We may correct pricing or listing errors. If an error affects a completed purchase, we will contact you and offer an appropriate correction, substitution, or refund.
8. Promotions and Discount Offers
Promotions, introductory offers, discount codes, drawings, spin-to-save offers, and other special offers may be subject to additional rules, expiration dates, eligibility requirements, and limitations.
Unless otherwise stated:
* Offers have no cash value.
* Offers cannot be combined with other discounts.
* Offers are limited to one redemption per person.
* Offers are subject to availability.
* Introductory offers are available only to eligible new customers.
* Discounts apply only to qualifying purchases.
* Offers may not be transferred or resold.
Chill may modify, suspend, or end a promotion when reasonably necessary, subject to applicable law. Any promotion-specific terms will control if they conflict with this section.
9. Communications
If you provide your email address or mobile number, you may receive transactional communications concerning appointments, purchases, waivers, account activity, or service updates.
If you separately consent to promotional communications, you may also receive marketing emails or text messages. Consent to marketing is not required to make a purchase. Message and data rates may apply. You may unsubscribe from emails using the link provided or opt out of marketing text messages by replying STOP.
Message frequency varies based on your activity and preferences.

10. Acceptable Website Use
You agree not to:
* Use the website for an unlawful or fraudulent purpose.
* Attempt to gain unauthorized access to the website, customer accounts, or related systems.
* Interfere with the website’s operation or security.
* Submit false, misleading, harmful, or malicious information.
* Copy, scrape, reproduce, or commercially exploit website content without permission.
* Impersonate another person or misrepresent your relationship with Chill.
We may restrict access when we reasonably believe these Terms have been violated.
11. Intellectual Property
The Chill name, logos, branding, website design, photographs, graphics, text, videos, and other original materials are owned by or licensed to Chill and are protected by applicable intellectual-property laws.
You may view and use the website for personal, noncommercial purposes. No content may be copied, modified, distributed, sold, or used commercially without prior written permission.
12. Third-Party Websites and Services
Our website may contain links to third-party websites, booking systems, payment processors, social-media platforms, research, or other services.
Chill does not control and is not responsible for the content, security, availability, privacy practices, or terms of third-party services. A link does not necessarily constitute an endorsement.
13. No Guarantee of Results
Individual responses to wellness and recovery services vary. Chill does not guarantee any particular physical, mental, athletic, cosmetic, recovery, or health outcome.
Customer reviews, testimonials, educational content, and descriptions of potential benefits represent individual experiences or general information and are not promises of specific results.
14. Website Disclaimer
We make reasonable efforts to keep website information accurate and available. However, the website and its content are provided on an “as available” basis.
To the fullest extent permitted by law, Chill disclaims warranties concerning the website’s uninterrupted availability, completeness, accuracy, security, or suitability for a particular purpose.
Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.
15. Limitation of Liability
To the fullest extent permitted by law, Chill will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of—or inability to use—the website.
Nothing in these Terms limits liability that cannot legally be limited or excluded. Participation-related risks and liability are addressed separately in Chill’s liability waiver.
16. Privacy
Information collected through the website, booking process, forms, and communications will be handled in accordance with Chill’s Privacy Policy and applicable law available at www.chillhealth.club/privacy-policy
You should review the Privacy Policy before submitting personal or health-related information.
17. Changes to These Terms
We may update these Terms periodically. Updated Terms will be posted on this page with a revised effective date.
Changes will apply prospectively unless otherwise required by law. Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms.
18. Governing Law
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.
Any legal proceeding relating to these Terms will be brought in a court of competent jurisdiction located in Johnson County, Kansas, unless applicable law requires otherwise.
19. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect. The affected provision will be enforced to the maximum extent permitted by law.
